Another feel-good dead robba story, komrades!

NEWARK -- An apparent robbery turned fatal in Newark early today when the would-be thief was killed in a fight with his intended victims, according to a police report.

Gian Davis, 30, approached two Newark college students walking on Bloomfield Avenue around 1:30 a.m. Saturday and asked to use one of their cell phones to call a cab, according to a Newark police report The Star-Ledger obtained.

One of the students said he would call a cab for Davis, who then said he wanted to shake the man's hand in thanks.

But instead of a handshake, Davis allegedly grabbed for the phone and started hitting one of the students in the head. The other student intervened and was able to subdue Davis by "placing a hold with both arms to restrain the suspect from further injuring his friend," the report stated.

Once Davis was in the hold, the two students called authorities.

"The other two parties actually summoned police to the scene and remained there at all times," said Chief Assistant Essex County Prosecutor Thomas S. Fennelly.

When the first officers arrived, the report said, the student released Davis, who was "unresponsive." Officers from the city's major crimes unit and the county homicide task force were then called to the scene along the 300 block of Bloomfield Avenue. Davis was taken to University Hospital, where he was pronounced dead less than an hour later.

Fennelly would not comment on the specifics of the case, saying it was still under investigation, but he said no charges had yet been filed.

"It is likely that the facts of this investigation will be presented to an Essex County grand jury," he said.
