A group of teenagers had boarded the train at the Skidmore Fountain station and bumped into the stroller about 8:20 p.m., said Sgt. Pete Simpson, a spokesman for the Portland Police Bureau. The woman said something to the group, which sparked an argument. The 11-year-old then walked up to the woman, Simpson said. "The kid lifts up his shirt and there's a gun," he said.

An 11-year-old boy was arraigned in juvenile court Friday afternoon, accused of threatening a woman on a TriMet MAX train with a loaded gun after bumping into her baby's stroller.

The boy faces allegations of unlawful use of a weapon, unlawful possession of a firearm, menacing, interfering with public transportation, possession of a loaded firearm and second-degree disorderly conduct.

Attorney Rachel Mortimer of the Metro Juvenile Defense Consortium represented the boy in court.

Led in by two Multnomah County sheriff's deputies who towered over him, the boy sat beside Mortimer, crying. He was dressed in a light-gray sweatshirt and sweatpants that appeared at least three sizes too big for his tiny frame.

Wiping tears from her eyes, his mother, Shaquita Louis, also took a seat at a table before the judicial referee.

Louis' daughter Yashanee Vaughn, 14, was killed last year and her body was found buried on Rocky Butte.

Mortimer urged the court to place the boy anywhere but detention.

"My client is very young. As you can see, this is not easy," Mortimer told the court, motioning to the boy, who had his head bowed, wiping his tears with his sleeve.

"I think it's imperative we get this child out of custody. Eleven-year-olds do not belong in detention," Mortimer said. "This is perhaps a wake-up call that he very much needs. ... He's terrified right now."

Juvenile court counselor Deirdra Gibson-Cairns said the juvenile department was concerned about "the level of supervision this youth yute has had."

Prosecutor Scott Harris and Gibson-Cairns urged the court to keep the boy in custody until a proper placement could be determined.

"We want DHS involved now so we can look at appropriate placement," Gibson-Cairns said. "We've started looking for temporary custody for him."

Louis, the boy's mom, urged the court to let her son stay with an aunt who was present in court. The aunt said she'd been a certified foster parent in the past.

Louis said she agreed she needs help, and her son needs a lot of counseling.

"We had a rough year," Louis told the court. A Yashanee red ribbon was pinned to her shirt. "I'm not using that ..."

Judicial referee David Knofler cut her off, "I'm very aware of all that."

Knofler ordered that the boy remain in custody and return for another hearing Monday to determine a future placement.

"This is a serious case, and because there are serious community safety issues," Knofler said.

Transit police arrested the 11-year-old Thursday night and seized a loaded .22-caliber handgun from his waistband.

He started to pull the gun out of the waistband of his pants and the woman backed off and called 9-1-1. She pointed out the suspect to officers when the train stopped at the Old Town/Chinatown platform, Simpson said.

Officers took the 11-year-old into custody after finding a loaded .22-caliber semi-automatic handgun in his waistband. They also arrested a 13-year-old boy who had a BB gun in his backpack.

"I'm blown away," Simpson said. "I'm a cop for 18 years and I've never heard of an 11-year-old with a gun."

The 13-year-old was taken to Janus Youth Program. Officers obtained a court order to lodge the 11-year-old in the Donald E. Long Juvenile Detention Home.

Police said they do not know yet how the child obtained the gun.

Transit Police Cmdr. Mike Crebs said his officers alerted the police bureau’s Gun Task Force to help determine how the 11-year-old got access to it.

“We’re going to look at every angle to find out how this child ended up with a loaded gun in his waistband,’’ Crebs said. “That’s not something we take lightly.’’

Penny Okamoto, executive director of Ceasefire Oregon, said whoever provided the child with the firearm or allowed him access to it should be held liable. A city ordinance adopted in December 2010 makes it a city crime to endanger a child by allowing access to a firearm. An adult would be guilty of the crime if he or she failed to prevent access to a firearm, whether loaded or unloaded, to a child without permission, or the permission of a parent or guardian. It would not apply if a child obtained a gun through illegal entry to a home, or if the gun was locked away, secured or inoperable.

"I think it's very disturbing," said Mary Fetsch, TriMet spokeswoman. "Trimet and transit is a reflection of the community we serve. We move a small city everyday. Some 330,000 times a day somebody steps aboard a bus or a train; given that, things will occasionally happen on our system."

Fetsch said the woman with the stroller did the right thing by calling 9-1-1 and not engaging with the boys.

"We tell our riders to be good witnesses. If you're uncomfortable, move, tell an operator or call 9-1-1. We don't want our riders to be put in harm's way.

"But when you hear something like this, it's very disturbing. I mean, an 11-year-old!"

The boy is already a ward of the taxpayers. Personally I can see the boy back in Mississippi - living with an a strict aunt, and away forever from his stupid motha. Put him to work when he's not in school! Working the fields is hard work, but it's honest work.
