This is the shocking moment a police officer launches a vicious assault on a 66-year-old-dementia sufferer.
Officer Derek Middendorf then tried to cover his tracks by deleting the recording from his dashcam.
But it has been recovered by technicians in Florida, in the US, and now the attorney for victim Albert Flowers told Florida Today that his client was prepared to sue the city of Melbourne.
'It’s clear (Officer Middendorf) tried to destroy all the video in this case. He thought he had turned off the camera, and that’s why he acted the way he did.'
The video shows Flowers calmly walking towards the police cruiser before Officer Middendorf suddenly delivers a kick to his groin.
Before Flowers is able to get up, the policeman drops to his knees and pounds his fists into Mr Flowers’ face.
Mr Flowers spent a month in the hospital after the beating.
Melbourne City Attorney Paul Gougelman promised to review the video to see if the city had any responsibility to pay for Mr Flowers’ health care.
'What I urge everybody to do is stand back and let the dust settle,' Mr Gougelman said. 'There is always more to the story. It’s always important to have a good working relationship in the community.'
Charges against Flowers were dropped by the Brevard County State Attorney’s Office after they learned about his dementia.
Middendorf was initially reprimanded for tampering with the recording device, but the city chose not pursue an administrative review at the time.
'Information regarding the arrest of Albert Flowers was sufficient to indicate that an internal investigation was not warranted,' Melbourne Police Chief Steve Mimbs said in a press advisory before the video was released. 'Officer Derek Middendorf is a valued officer whose record since joining the department in 2005 reflects the fact that he has done a very good job for the city.'
Middendorf indicated in his report that he used force against Flowers after the man did not obey orders to stop moving toward him. The officer said he suspected Mr Flowers may have had a knife.
'I had to react and protect myself in fear he was going to attack me,' the report said. 'Not knowing if he was still armed or not … I struck the defendant in the face to distract him.'
Mr Flowers’ dementia has worsened since returning home from the hospital, according to his granddaughter, Donna Jackson.
'The family’s just upset by the whole thing,'Ms Jackson explained. 'We are glad they dropped the charges. We just want to move forward.'

Second, what he means by 'a good working relationship in the community' means the ability to beat, frame or kill those they chose without any repurcussions.

These types of attacks by the growing Police States of Australia, the U.K., Canada and America are only going to greatly increase. The families are cowards, and totally disloyal to their family members. They cower in fear of offending the local police, State authorities, and Federal agencies, especially the TSA.
If the TSA is totally confident in offending individuals like Senator Paul, were the fuck do you think that leaves ordinary citizens having to cope with local yokels. In a shit pile of abuse !!!

I know of one case in the UK where Police made a false arrest of a guy some Airport worker said "MIGHT HAVE" comitted an offence; the Cops arrested him with violence in front of his wife and children at check-in on recorded CCTV; then when they got to the Airport police station the cops realsied their fuck up and deleted all the CCTV; however, because a complaint was made, the cops didnt charge him until afer 30 days when ALL the Airport CCTV was deleted as well; all the CCTV proving his innocence and ALL the CCTV of the cops attack on him. The suspect had to have a hospital operation due to the damage the police did.
I dont think anywone should support police getting rid of CCTV which proves a suspects innocence.
The police tried the same in the Charles De Mendez case.
Many people call the cops "THE FILTH" across the UK these days.
Luckily the dude got found innocent at trial. The cops got let off with a nudge and a wink. For now.

I can understand the copper being wary of the bloke walking towards him initially and the fact he was ignoring the order 2 not come closer but the poor bloke/victims hands were in the open and in plain sight -
it looked 2 me as if the copper was trying 2 slip him a length whilst on top of him - no I should not make fun of it but the fact he could not free his arm and get him cuffed was amusing
if the law really believed he could have been attacked why didn't he pull his gun?? anyone that then kept walking would have 2 be a lunatic
I know the law obviously stepped over the mark and ignored his 'serve and protect' oath but 2 me the most compelling evidence against him is the fact he tried 2 get rid of the recording -
if he genuinely believed he was going 2 be attacked or was in fear of his personal safety he would not have (on reflection) ditched or attempted 2 ditch the video
I bet this cop is none the worse for this and no action will be taken against him as I remember the Rodney King episode that ended up with riots on the streets

I think the best outcome for the victim is that the authorities cough up a lot of compensation without the need for a trial because how is a man with dementia supposed 2 give evidence ??

Any assault on one of the Imperial Guards would bring an investigation and prosecution that you wouldn't believe. They would act like you were John Dillinger. They might give early release to child rapists (think Pippin) or murderers but you would serve hard time.
